U.S. Plans To Expel Thousands Of Chinese Graduate Students With Ties To China’s Military Schools

LAGOS MAY 30TH (NEWSRANGERS)-The Trump administration plans to cancel the visas of thousands of Chinese graduate students and researchers in the United States who have direct ties to universities affiliated with the People’s Liberation Army.

Rebecca Bernhard is a partner at the international law firm Dorsey & Whitney in both its immigration and labor and employment practices who have read the  proclamation disclosed, “The actual suspension likely will impact a narrow number of graduate students and scholars.  However, because of the scrutiny to determine which students will be suspended from entry, all students and scholars will face a lot of questions and the burden will likely be on the students and scholars to document that their research program is NOT subject to the bar – it appears the presumption is that the bar applies and the student or scholar will need to document that it does not. Unfortunately, this suggests to me that there will be even more delays at US consulates (when they finally re-open) for all Chinese graduate students and scholars in engineering,” Bernhard says. 

“While it is difficult to know what happens to current students or scholars already in the US, if these approved scholars leave and must then apply for a (new or renewed) visa at a consulate, they will be subject to this additional scrutiny,” Bernhard says. 

Bernhard says this will not impact Chinese nationals on other US visas,

“This particular proclamation only applies to people in F and J visas.  Of course, at this moment the general moratorium issued in the proclamation from April is still in place and consulates remain closed.  And the COVID-19 related ban is also still in effect,” Bernhard says.
